Advertising RegulationsApril 29, 2009 on Twitter I was out on some business for a few hours. When I came back to my computer there was a tweet from Eaton Compliance. This started a conversation about advertising regulations and the Life Settlement Industry. Eaton Compliance Website EatonCompliance@kwfitzner Curious to see your advice re: licensing issues when marketing life settlements over the internet. Always a tricky issue. kwfitzner@EatonCompliance Prickly issue. I don't buy or sell. I write and publish info providing others a place to put Google and other ads. More EatonCompliance@kwfitzner Ah, I see. Laws slow to follow technology on that one. I do see a lot of confusion on that topic in LS (also insurance producers) @EatonCompliance Even so many states do not allow any sort of guarantees, stated interest rates or such. @EatonCompliance My tracking software tells me every month that I have visits from the gov't. @kwfitzner Clients are always a little shaken when I tell them to check their site stats. Ad & licensing laws become top priority :-) @kwfitzner Two fold issue. Sales text used in ads & some state require prior approval. And are they licensed in states where they advertise. @EatonCompliance I would think it would be prudent to abide by the strictest rule when advertising on the web. @kwfitzner NAIC model law intended for insurers but helpful to LS. There are a few levels of ads - institutional vs product vs solicitation @EatonCompliance Besides my home page the pages on regulations are the most visited pages on my site. A lot of folks worry about this. @kwfitzner Nice you have links to statues & regs in one place for industry folks. They just need to keep current on them, not too hard. @EatonCompliance Thankyou, Many states are slow to update their websites. Folks working in this industry should seek qualified advisers.
